RULES OF THE EVIKE EUROPE PHOTO CONTEST

ARTICLE 1 - THE ORGANIZING COMPANY

The company Dolomede Evike Europe (hereinafter referred to as "Evike Europe"), registered in the Nanterre Trade and Companies Register under number 431 984 533 and whose registered office is located at 40 boulevard Henri Sellier - 92150 Suresnes, France, hereinafter referred to as the "Organizing Company", organizes a weekly photography contest (hereinafter referred to as the "Contest"), under the conditions described below.

ARTICLE 2 - SUMMARY DESCRIPTION OF THE CONTEST

2.1
Participation in this photography contest is free.
In order to participate in the Contest, participants are invited to post their photo on Evike Europe's social networks:

2.2
The designation of the best photo by the Evike Europe jury will allow the winner to win points (hereinafter "Rewards") equivalent to a sum of money that can only be spent on the Evike Europe website www.evike-europe.com (hereinafter "the Site").

2.3
Each winner will receive 250 Rewards worth between 10 and 25 Euros depending on the level reached by the winner at the time of the Contest.

ARTICLE 3 - PARTICIPANTS

3.1
Participation in this Contest is open to any natural person who is of legal age, criminally responsible and legally resident in the European zone excluding Turkey and Russia, with the exception of members of the staff of the Organizing Body and, more generally, of the companies participating in the implementation of this Contest.

3.2
Participation in this Contest implies full and complete acceptance by the participants of the Rules in all their provisions, conditions and terms of participation as well as the principle of the Contest.

3.3
Any person who contravenes one or more of the articles of the Rules will be deprived of the possibility of participating in the Contest, as well as of the prize that he/she could have won.

ARTICLE 4 - PARTICIPATION IN THE CONTEST

4.1
Every Monday, for one week, customers wishing to participate in the Contest may post a photo of their airsoft game:
By commenting on the Facebook post dedicated to the Evike Europe Contest, and/or ;
By posting an Instagram story identifying the Evike Europe Instagram account.

In order to contact the winner and award the Rewards, a customer account will need to be created on the Site www.evike-europe.com with all necessary contact information. Personal information will be requested, such as title, last name, first name, e-mail address, mailing address and telephone number. The creation of a customer account is essential to use the Rewards and to buy products on the Site.

4.2
Only entries that have been correctly filled out will be considered. It is strictly forbidden to play using another person's identity.
Any incomplete, inaccurate or fanciful entry will not be taken into account and will be void. The Organizing Body reserves the right to carry out any useful checks for the proper application of the Rules and in particular to verify the identity of the participant.
No claim may be accepted if the participant has indicated an invalid and/or incorrect e-mail address.

4.3
A participant's proven intention to cheat or attempted cheating will be sanctioned by a formal and definitive ban on participating in the Contest for its entire duration and will also result in the nullity of all entries submitted with the same account. To this end, the Organizing Body reserves the right, in particular, to compare the technical data on its servers (in particular, the IP addresses) associated with the Contest entries. The Organizing Body reserves the right, in all cases and even in cases of doubt, to prosecute the authors of such fraud before the competent courts.

ARTICLE 5 - METHODS OF DESIGNATING THE WINNER

5.1
The designation of the winners will take place at the end of the week following the deliberation of the Evike Europe jury.

5.2
In order to decide, the jury will notably appreciate :

the respect of the theme and the conditions of validity of participation
the integration of airsoft products
originality
the harmony of the colors

ARTICLE 6 - THE ENDOWMENTS

6.1
The winners will be personally informed by email at the address indicated during registration on the Site within seven (7) days of the closing of the Contest.

6.2
The prizes shall be awarded to the winners by e-mail by the Organizing Body within seven (7) days of the end of the Contest.

6.3
The Contest prize consists of 250 Rewards with a monetary value equivalent to the level reached by the winners. The level increases according to the amount of purchases made on the Site by the customer.

6.4
The monetary value will be higher or lower depending on the level:

6.5
The Organizing Body reserves the right to replace the prize, in whole or in part, with another prize of equivalent value, in particular in the event of difficulties in obtaining what was announced.

6.6
The prize is nominative and will not be exchangeable or refundable in cash, nor retroactive, nor extendable.

ARTICLE 7 - TRANSFER OF RIGHTS AND PUBLICITY

7.1
By publishing a photograph to the Organizing Body, the candidate acknowledges :
being the original author of the photograph ;
to transfer free of charge to the Organizing Company the rights of reproduction, representation, adaptation, arrangement, modification, use and integration of the said photograph under the conditions described below.

7.2
By validating his or her participation, the participant agrees that the photograph submitted may be published on the www.evike-europe.com website, on the Organizing Company's advertising banners, on any internal and institutional communication medium of the Organizing Company and on any external communication medium or in partnership with other companies, without any limitation in terms of quantity or duration as of the start of this Contest, and without any consideration.

7.3
The participant also accepts that the photograph posted may be modified by the Organizing Body, in particular for questions of size or computer ownership.

7.4
Subject to their express consent, the winners may be advertised and promoted in all present or future media as part of any advertising or promotional message or event, without this authorization giving rise to any right to compensation other than the prize offered.

ARTICLE 8 - MODIFICATION OF THE RULES

8.1
The Organizing Body reserves the right to cancel, postpone, extend, shorten or modify the Rules in whole or in part if circumstances beyond its control require it to do so without having to justify this decision and without its liability being incurred in any way as a result.

8.2
Any modification shall be communicated in the form of an amendment on the Organizing Body's Site.

ARTICLE 9 - LIABILITY

The Organizing Body declines all responsibility for any incidents and/or accidents that may occur during the enjoyment of the endowment awarded and/or due to its use.

ARTICLE 10 - FILING OF THE RULES

The Rules shall come into force as of their posting on www.evike-europe.com and all participants shall be deemed to have accepted them by the simple fact of their participation in the Contest.
Any participant refusing to accept the modifications made must stop participating in the Contest.

ARTICLE 11 - INTELLECTUAL PROPERTY

11.1
In accordance with the laws governing intellectual property rights, the reproduction and representation of all or part of the elements making up the Contest and/or available on the Evike Europe Site are strictly prohibited. The brands mentioned are registered trademarks of their respective owners.

11.2
All trademarks, logos and other distinctive signs reproduced on the various communication media dedicated to the Contest and/or accessible on the Site, are or are likely to be the exclusive property of their owners and are protected. Any unauthorized reproduction of these trademarks, logos and protected signs constitutes an infringement liable to criminal and civil penalties, including the payment of damages to the Organizing Body. Any use of the elements of the Contest and/or the products on sale on the Organizing Body's Site, regardless of the method, is subject to compliance with the rules of intellectual property.

ARTICLE 12 - PERSONAL DATA

12.1
Participants' personal data are processed by Evike Europe, as the data controller, in accordance with the French Data Protection Act n° 78-17 of January 6, 1978 and the European Regulation n° 2016/679 on the protection of personal data ("RGPD").

12.2
By completing the contact information for any registration or order made on the Site, the participant authorizes the Organizing Body to collect his/her personal data.

12.3
The Organizing Body collects and processes the participants' personal data (title, first name, surname, postal address, telephone number, e-mail address) on the basis of Article 6 (1) (b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (RGPD) in order to be able to deliver the ordered products, take into account the participation in the Contest and contact the winners at the end of the jury deliberation.

12.4
Participants have the right to access, delete, rectify or oppose their personal data at any time. Participants may also request that their personal data be provided in a structured and standard format.
Participants may exercise their rights by providing proof of their identity and sending their request to the Organizing Body by e-mail to support@evikeeurope.com or by mail to the address of the Organizing Body's registered office, located at 40 boulevard Henri-Sellier, 92150 Suresnes, France.

12.5
At the end of the Contest, the participants' personal data will be kept in their customer account and will not be transmitted to third parties.

In accordance with European regulations, the Organizing Body undertakes to keep the participants' personal data only for the time necessary to achieve the purposes.

In order to calculate these retention periods, the Organizing Body relies in particular on the following criteria
The time necessary to process the participation in the Contest;
The participant's interest in the Organizing Body's advertising messages;
The legal or regulatory obligations of the Organizing Body.

The personal data of customers is kept for a period of 3 years from the last modification or 6 years after the last order unless otherwise provided by law.

12.6
The Organizing Body may keep, in its archives, certain personal data in order to be able to respond to any legal action, and this for the duration of the statute of limitations provided for by the applicable legislation.

ARTICLE 13 - APPLICABLE LAW AND JURISDICTION

13.1
The Regulations are subject to French law.

13.2
In the event of a dispute or claim, for any reason whatsoever, requests must be sent to the Organizing Body no later than 2 months after the end of the Contest (as evidenced by the postmark).

13.3
Any dispute arising in connection with the Contest, and failing amicable resolution, shall fall under the exclusive jurisdiction of the courts of the headquarters of the Organizing Body.
