Article 01

Scope and application

These general terms and conditions of sale ("T&Cs") apply in full to all orders placed by any customer, whether an individual or legal entity (the "Customer"), with the company DOLOMEDE EVIKE EUROPE SARL (the "Seller"), registered at 40 boulevard Henri-Sellier, Suresnes (92150) France, RCS Nanterre 431 984 533 / VAT: FR49431984533, and to all invoices issued by it.

They apply to the exclusion of all other conditions, in particular those applicable to online sales or other distribution and commercial channels.

Article 02

Pre-contractual information

2.1 — Acceptance of T&Cs

Prior to purchase, these T&Cs are made available to the Customer for information purposes. The Customer acknowledges having read these T&Cs before placing their order, as well as all the information listed in Article L. 221-5 of the French Consumer Code. They declare their acceptance in accordance with Article 1119 of the French Civil Code.

In the event of non-compliance with these T&Cs, DOLOMEDE EVIKE EUROPE reserves the right to suspend the sale without prejudice to any damages it may claim.

2.2 — Replica regulations

DOLOMEDE EVIKE EUROPE reminds customers that the distribution and sale of replicas are subject to the strict requirements of Decree no. 99-240 of 24 March 1999:

  • Article 1: The offer, sale and supply of objects resembling firearms, designed to fire rigid projectiles generating energy above 0.08 joules and up to 2 joules, are regulated.
  • Article 2: The sale, free distribution or supply of such products to minors is prohibited.
⚠ DOLOMEDE EVIKE EUROPE cannot be held liable in the event of resale of a replica to a person who does not meet the requirements in force in their country of residence.
Article 03

Products and services

3.1

All products and services offered by DOLOMEDE EVIKE EUROPE are available online at www.evike-europe.com. They may be available in limited quantities and may only be returned or exchanged in accordance with our returns policy. We cannot guarantee a perfect match with the products displayed (e.g. colours on screen).

3.2

We reserve the right to limit or discontinue sales of any product or service to any person, in any geographic region or jurisdiction. All product descriptions and prices may be changed without prior notice, at our sole discretion. Any offer is void where prohibited by law.

Article 04

Orders

Any order received by the Seller is deemed firm and final. It constitutes full and unconditional acceptance of these T&Cs and an obligation to pay for the ordered products. Orders are placed at www.evike-europe.com.

An acknowledgement of receipt does not constitute acceptance of the order by DOLOMEDE EVIKE EUROPE. The Customer agrees to receive invoices electronically.
Article 05

Delivery and cancellation

5.1 — Delivery address

Delivery is made exclusively to the address provided at the time the order is finalised. No claim may be made for failure to receive an order due to an incorrect address not notified to us.

5.2 — Delivery errors

In the event of a delivery error (wrong recipient or products not matching the order), DOLOMEDE EVIKE EUROPE will bear all return and re-delivery costs.

5.3 — Out of stock

In the event of a temporary stock shortage, DOLOMEDE EVIKE EUROPE reserves the right to split the order. Any additional shipping costs will be borne by DOLOMEDE EVIKE EUROPE.

5.4 — Customs clearance

Each customer orders in full knowledge of the rules applicable in their country. In the event of goods being held or returned to sender, DOLOMEDE EVIKE EUROPE cannot be held liable. Any re-delivery shipping costs remain the Customer's responsibility.

5.5 — Cancellation for late delivery

In the event of failure to deliver on time, the Customer may cancel the order after 30 days (mainland France) or 60 days (rest of the world), in accordance with Articles L. 216-2, L. 216-3 and L. 216-4 of the French Consumer Code.

5.6 — Missing or damaged goods

In the event of missing or damaged goods during transit, the Customer must note precise reservations on the delivery note upon receipt, and confirm them in writing within 3 working days of delivery by recorded letter with acknowledgement of receipt.

By signing the delivery note without reservations, the Customer accepts the goods and waives all claims. The Customer has the right to check the contents of the parcel in the presence of the carrier before signing.
5.7 — Customs duties

For orders to certain countries (particularly outside the EU), customs duties or local taxes may apply. These charges are the sole responsibility of the Customer.

Article 06

Right of withdrawal

6.1 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, you have 14 days from receipt of your order to exercise your right of withdrawal, without giving reasons or incurring penalties.

⚠ Any return request that does not comply with our conditions or is submitted after the deadline may be refused. In the event of an unauthorised return, DOLOMEDE EVIKE EUROPE reserves the right to refuse the parcel or charge re-delivery costs.
6.2 — How to exercise your right

6.3 — Returns information

Products returned in their original condition, unused, complete (accessories, packaging, documentation) will be refunded at 100% of the price paid. Delivery charges billed at the time of ordering are also refunded at 100%, in accordance with Article L.221-24 of the French Consumer Code.

  • Use a tracked shipping method and retain proof of postage
  • Returns sent to a collection point will not be accepted
6.4 — Return shipping costs

Return shipping costs are the Customer's responsibility, unless the return is due to an error on our part. For returns from outside the Schengen Area (United Kingdom, Switzerland), import duties may apply and remain the Customer's responsibility.

6.5 — Refund

The refund will be processed within 14 days of receipt and verification of the returned products, using the same payment method used at the time of ordering.

6.6 — Exclusions

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalised, nor to goods that may deteriorate rapidly.

Article 07

Prices

All prices displayed on the website are expressed in the legal currency and are inclusive of all taxes (VAT included). Prices are fixed and final at the time of ordering.

Article 08

Payment

Payment is required at the time of ordering. No goods are dispatched before full payment is received. Two payment methods are available:

  • Credit/debit card via the secure platform Payplug or Alma (instalment payment)
  • PayPal
Article 09

Warranties

9.1 — Hidden defects

In accordance with Articles 1641 et seq. of the French Civil Code, DOLOMEDE EVIKE EUROPE warrants its products against hidden defects.

9.2 — Legal warranty of conformity

DOLOMEDE EVIKE EUROPE warrants the conformity of goods sold, in accordance with Articles L. 217-4 et seq. of the French Consumer Code. Any action arising from a lack of conformity must be brought within 2 years of delivery of the goods.

9.3 — Mechanical and electronic warranty (12 months)

Replicas purchased on the website are covered by a 12-month mechanical and electronic warranty under normal use and without any unauthorised modifications, in accordance with the manufacturer's technical specifications.

⚠ This warranty does not cover defects caused by abnormal or improper use. Any operation not reported to and/or approved by a DOLOMEDE EVIKE EUROPE technician may result in a refusal of repair.
9.4 — Batteries and parts (14 days)

Batteries and other wear parts sold are covered by a 14-day warranty against manufacturing defects. The warranty is personal, applies only to individuals and cannot be transferred to a third party.

Article 10

Legal warranty of conformity

  • 2 years from delivery of the goods to bring a claim
  • Choice between repair or replacement of the goods, subject to the cost conditions of Article L. 217-9 of the French Consumer Code
  • No need to prove the lack of conformity during the 24 months following delivery
Article 11

Force majeure

Neither party may be held liable for delay or failure in the event of force majeure within the meaning of Article 1218 of the French Civil Code, including in particular:

  • Natural disasters (earthquake, storm, fire, flood)
  • Armed conflict, war, terrorist attacks
  • Total or partial strike at DOLOMEDE EVIKE EUROPE, its subcontractors or carriers
  • Mandatory government orders (embargo, import ban)
  • Pandemic recognised by the WHO or public health emergency declared by the authorities

If the event lasts more than 60 days, either party may terminate the contract with 30 days' written notice.

Article 12

Promotions and loyalty programme

DOLOMEDE EVIKE EUROPE offers occasional promotions and a loyalty programme allowing members to benefit from a percentage discount on all products, according to a scale available on the website. This scale may be modified at any time without prior notice.

Article 13

Intellectual property

All trademarks, licences, logos and elements forming the website are the property of DOLOMEDE EVIKE EUROPE and are protected by applicable intellectual property rights. Customers agree not to make any use of these elements that could infringe those rights, and not to disclose them to any third party.

Article 14

Personal data protection

The Customer's personal data is processed by DOLOMEDE EVIKE EUROPE, as data controller, and is necessary for the management of your order and our commercial relationship.

14.1 — Data collected

Data collected includes: first name, last name, email address, date of birth (account creation), connection and location data, postal address and phone number (payment). Cookies are used — the Customer may disable them in their browser settings.

14.2 — Retention period
  • 3 years from last activity or 6 years after the last order
  • 13 months for audience measurement statistics
  • 10 years for past invoices

Article 15

E-gift cards

  • Validity period: 12 months from the date of purchase. Any remaining balance will be forfeited upon expiry.
  • May only be used by an adult individual for a single order on the website, up to the loaded amount.
  • One e-gift card per order. The remaining balance may be paid by credit/debit card or PayPal.
  • Non-exchangeable, non-resaleable and cannot give rise to any monetary consideration.
  • In the event of a return, the refund is credited back to the e-gift card (automatically re-credited) or issued as a voucher if the card has expired.
The recipient is responsible for their e-gift card. Lost or stolen cards may be blocked, provided the card is still valid. Amounts already used cannot be refunded.
Article 16

Third-party links

Certain content available through our website may include elements from third parties. We do not guarantee and assume no responsibility for the content, products or services accessible on those third-party websites.

Article 17

Transfer of risk

Transfer of ownership and risk of loss or damage only takes place when the carrier takes charge of the purchased product.

Article 18

Language of contract

These T&Cs are written in French and in English. Only the French text shall prevail in the event of a dispute.

Article 20

Jurisdiction

Any dispute that could not be resolved amicably is subject to French law. Failing an amicable resolution, the dispute will fall under the exclusive jurisdiction of the competent court. In all cases, the Customer may also bring proceedings before the court of their place of residence.

Article 21

Amendment of T&Cs

DOLOMEDE EVIKE EUROPE reserves the right to amend the T&Cs at any time. Any order placed after a new version comes into force constitutes full and unconditional acceptance of that version.

Article 22

Account deactivation

Failure to comply with obligations, payment incidents, conduct contrary to the interests of DOLOMEDE EVIKE EUROPE, or the provision of false information may result in account suspension or termination, without any claim for damages being possible.

Box of Awesomeness

⚠ Our Box of Awesomeness is an "advertising lottery" considered a game of chance, excluded from the scope of certain provisions of the French Consumer Code and the French Internal Security Code. It is not subject to the 14-day right of withdrawal and its contents are neither exchangeable nor refundable.
