Raffle rules
ARTICLE 1 - THE ORGANIZING COMPANY
Dolomede Evike Europe (hereinafter referred to as "Evike Europe"), a company (société à
responsabilité limitée) whose registration number is 431 984 533 with the registered office at at
40 boulevard Henri Sellier - 92150 Suresnes, France (hereinafter referred to as the "Organizing
Company"), is organizing a raffle (hereinafter referred to as the "Raffle") from June 03, 2022 to
July 01, 2022 (hereinafter referred to as the "Period"), for the launch of the Evike Europe e-
commerce website, in accordance with the terms and conditions described below.
ARTICLE 2 - SUMMARY DESCRIPTION OF THE RAFFLE
2.1
The Raffle organized by Evike Europe is a Raffle with a purchase obligation.
2.2
In order to participate in the Raffle, participants are invited to make, during the Period, purchases
of the amount of their choice on the website www.evike-europe.com (hereinafter "the Website").
2.3
Every seven (7) days a new random draw will determine a new winner. The list of participants will
be reset to zero at the end of each random draw.
2.4
The winner will obtain a prize in the form of a voucher on the Website of the same value as his or
her basket, with a maximum value of 500 euros.
ARTICLE 3 - PARTICIPANTS
3.1
Participation in this Raffle is open to any natural person of legal age, criminally responsible and
lawfully resident in the European zone (including Turkey and excluding Russia), excluding
members of the Organizing Company's staff and, in general, companies participating in the
implementation of this Raffle.
3.2
Participation in this Raffle implies, by the participants, the full and complete acceptance of the
Regulation in all its provisions, terms and conditions of participation as well as the principle of the
Raffle.
3.3
Any person who contravenes one or more of the articles of the Regulation will be deprived of the
possibility of participating in the Raffle, as well as of the prize that he/she could have won.
ARTICLE 4 - TERMS AND CONDITIONS OF PARTICIPATION
4.1
Participation in the Raffle is open from June 03, 2022 to
July 01, 2022, i.e. a period of 28 days. Any order placed during this Period on the Website
ensures participation in the Raffle.
The date and time of the order placed by the candidates shall be recorded by the computer
systems of the Organizing Body.
4.2
Any participation outside of this Period shall not be counted. Nevertheless, the Organizing Body
reserves the right to terminate the Raffle early in the event of the occurrence of a case of force
majeure or any event outside its control making the continuation of the Raffle impossible. The
responsibility of the Organizing Company cannot be engaged in this fact. No compensation will
then be payable by the participants.
ARTICLE 5 - PARTICIPATION IN THE RAFFLE
5.1
In order to participate in the Raffle, participants are invited to make purchases during the Period
of the amount of their choice on the Website www.evike-europe.com. During seven (7) days,
each participant will be able to make purchases and try to win the prize of the week for which
he/she participates.
5.2
Each week, only one winner will be drawn thanks to his/her order number. The list of participants
will be reset to zero at the end of each random draw.
5.3
In order to validate his or her registration for the raffle and have a chance to win, the participant
must fill in all the required fields when ordering. Among the mandatory fields, personal information
such as title, last name, first name, e-mail address, postal address and telephone number will be
requested from the participant in order to proceed with the payment of the order. This information
is essential to deliver the ordered products but also to contact you in case of winning.
5.4
Only orders for which the information has been correctly filled in will be taken into consideration. It
is strictly forbidden to play using another person's identity.
Any incomplete, inaccurate or fanciful participation will not be taken into account and will result in
its nullity. The Organizing Body reserves the right to carry out any useful checks for the proper
application of the Regulation and in particular to verify the identity of the participant.
No claim may be accepted if the participant has indicated an invalid and/or incorrect e-mail
address.
5.5
A participant's proven intention to cheat or attempted cheating will be sanctioned by a formal and
definitive ban on participating in the Raffle for its entire duration and will also result in the nullity of
all entries submitted with the same account. To this end, the Organizing Body reserves the right
to compare the technical data on its servers (in particular the IPs) associated with the entries in
the Raffle. The Organizing Body reserves the right, in all cases and even in case of doubt, to
prosecute the perpetrators of such fraud before the competent courts.
ARTICLE 6 - THE RANDOM DRAW
6.1
The four (4) random draws, corresponding to the four (4) weeks of the Period, will take place on
the following dates:
- June 10, 2022
- June 17, 2022
- June 24, 2022
- July 01, 2022
6.2
Weekly order numbers will be drawn. The time of the random draw will be specified on the Evike
Europe Website on the day of the random draw.
6.3
The random draws will take place at the headquarters of the Organizing Company in the
presence of a representative of the company and several witnesses.
The random draws will be filmed to attest to their compliance and proper conduct. They will be
carried out in public by the innocent hand of a person who is not part of the Organizing Company.
6.4
The winner of the week will be informed by e-mail, once the random draw has been carried out,
and his/her prize will be effective upon receipt of the e-mail.
ARTICLE 7 - THE ENDOWMENTS
7.1
Four (4) winning baskets corresponding to the 4 random draws over the Period are put into play,
thus one (1) winning basket will be awarded every 7 days.
7.2
The prize won is a purchase voucher on the Website of the same value as the order made
corresponding to the order number drawn at random.
The maximum value of the refund of the order will not exceed the sum of 500 euros.
7.3
The Organizing Company reserves the right to replace the prizes, in whole or in part, with other
prizes of equivalent value, in particular in the event of difficulties in obtaining what has been
advertised.
7.4
The prize is nominative and will not be exchangeable or refundable in cash, nor retroactive, nor
extendable.
ARTICLE 8 - PUBLICITY AND PROMOTION OF WINNERS
Subject to their express consent, the winners authorize the Organizing Company, by any means
whatsoever, to reproduce and use their last name, first name and city of residence.
The winners may be advertised and promoted in any present or future media as part of any
advertising or promotional message or event, without this authorization giving rise to any right to
compensation other than the prize offered.
ARTICLE 9 - MODIFICATION OF THE REGULATION
9.1
The Organizing Company reserves the right to cancel, postpone, extend, shorten or modify the
Regulation in whole or in part if circumstances beyond its control require it to do so, without
having to justify this decision and without its liability being engaged in any way as a result.
9.2
Any modification shall be communicated in the form of an amendment on the Website.
ARTICLE 10 - LIABILITY
The Organizing Company declines all responsibility for any incidents and/or accidents that may
occur during the enjoyment of the awarded prize and/or due to its use.
ARTICLE 11 - REGISTRATION OF THE REGULATION
The Regulation will come into force as soon as it is put online on www.evike-europe.com and any
participant will be deemed to have accepted them simply by participating in the Raffle.
Any participant refusing to accept the modifications that have been made must stop participating
in the Raffle.
ARTICLE 12 - INTELLECTUAL PROPERTY
12.1
In accordance with the laws governing intellectual property rights, the reproduction and
representation of all or part of the elements making up the Tombola and/or available on the Evike
Europe Website are strictly prohibited. The brands mentioned are registered trademarks of their
respective owners.
12.2
All trademarks, logos and other distinctive signs reproduced on the various communication media
dedicated to the Raffle and/or accessible on the Website, are or are likely to be the exclusive
property of their owners and are protected. Any unauthorized reproduction of these trademarks,
logos and protected signs constitutes an infringement liable to criminal and civil penalties,
including the payment of damages to the Organizing Company. Any use of the elements of the
raffle and/or products on sale on the Organizing Company's Website, regardless of the method, is
subject to compliance with the rules of intellectual property.
ARTICLE 13 - PERSONAL DATA
13.1
Participants' personal data are processed by Evike Europe, as the data controller, in accordance
with the French Data Protection Act n° 78-17 of 6 January 1978 and the European Regulation n°
2016/679 on the General Data Protection Regulation (“GDPR”).
13.2
By completing the contact information for any order placed on the Website, the participant
authorizes the Organizing Company to collect his/her personal data.
13.3
The Organizing Company collects and processes the participants' personal data (title, first name,
surname, postal address, telephone number, e-mail address) on the basis of Article 6 (1) (b) of
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016
(GDPR) in order to be able to deliver the ordered products, take into account the participation in
the Raffle and contact the winners at the end of the random draws.
13.4
Participants have the right to access, delete, rectify or oppose their personal data at any time.
Participants may also request that their personal data be provided in a structured and standard
format.
Participants may exercise their rights by providing proof of identity and sending their request to
the Organizing Company by e-mail to [support@evike-europe.com] or by mail to the address of the Organizing Company's
registered office, located at 40 boulevard Henri-Sellier, 92150 Suresnes, France.
13.5
At the end of the Raffle, the participants' personal data will be kept on their customer account and
will not be transmitted to third parties.
In accordance with the European Regulation, the Organizing Company undertakes to keep the
participants' personal data only for the time necessary to achieve the purposes.
In order to calculate these retention periods, the Organizing Company relies in particular on the
following criteria:
- The time required to process participation in the Raffle;
- The participant's interest in the Organizing Company's advertising messages;
